Terms of Service

1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Vexelgen (the “Service”), operated by us (“Vexelgen,” “we,” “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. The Service

Vexelgen lets you generate AI images and video from text prompts and, optionally, your own uploaded images, using third-party AI models (currently including Kling, Seedance, GPT Image 2, and Nano Banana 2). We route your requests to these underlying model providers to produce the output — we do not train or operate the models ourselves. Model availability, capability, and output quality can change as providers update their systems, and we may add, remove, or substitute models at our discretion.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Credits, subscriptions, and billing

• The Service is credit-based. Credits are consumed when you submit a generation and are deducted upfront; if a generation fails on our end (provider error, or all available providers unavailable), the credits for that attempt are automatically refunded to your account. Credits are not refunded for generations that complete successfully, even if you are unsatisfied with the output — AI generation is inherently variable and we cannot guarantee any particular result.
• Subscription plans renew automatically each billing period until canceled and grant a fixed number of credits per cycle, which expire at the end of that billing cycle if unused.
• One-time credit packs are purchased separately, are currently available only to active subscribers, and their credits expire 12 months from purchase.
• All payments are processed by Stripe. We do not store your full payment card details.
• You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods except where required by law.
• We may change pricing prospectively with notice; changes do not apply retroactively to periods already paid for.

6. Acceptable use

You agree not to use the Service to generate, upload, or distribute content that:

• Depicts child sexual abuse material in any form — this is prohibited absolutely, with zero exceptions, and will result in immediate account termination and reporting to relevant authorities.
• Is illegal under applicable law, including content that infringes another party’s intellectual property, publicity, or privacy rights.
• Depicts a real, identifiable person in a sexually explicit, defamatory, or otherwise non-consensual manner (including “deepfake” content) without that person’s consent.
• Is intended to harass, threaten, defraud, or impersonate any person or organization.
• Promotes violent extremism, terrorism, or self-harm.
• Attempts to circumvent, probe, or abuse the underlying AI providers’ own content moderation systems, or to reverse-engineer the Service.

Prompts and generation requests are also subject to the content policies of the underlying AI model providers, which may reject or flag a request independently of our own review. We may remove content, refund the associated credits, and suspend or terminate accounts that violate this section, at our discretion and without prior notice for serious violations.

7. Ownership of generated content

Subject to your compliance with these Terms and payment for the applicable credits, you own the output you generate through the Service, to the extent ownership of AI-generated content is recognized under applicable law (this varies by jurisdiction and is an unsettled area of law in some places). You grant us a limited license to store, process, and display your prompts, uploaded images, and generated output solely as needed to operate and improve the Service (for example, to display your generation history and gallery back to you, and to transmit your request to the underlying AI provider). We do not claim ownership of your generated content, and we do not use it to train our own models.

Underlying AI model providers may have their own usage terms that apply to output generated through their models; you are responsible for complying with those terms as well.

8. Disclaimers

THE SERVICE AND ALL GENERATED OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI-GENERATED OUTPUT MAY BE INACCURATE, UNEXPECTED, OR UNSUITABLE FOR YOUR INTENDED USE, AND WE DO NOT WARRANT THE ACCURACY, QUALITY, OR APPROPRIATENESS OF ANY GENERATED CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VEXELGEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violating these Terms. Unused subscription credits are forfeited on termination for cause; we’ll otherwise handle account closures reasonably and in good faith.

11. Changes to these Terms

We may update these Terms from time to time. We’ll post the updated version here with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
